These Terms & Conditions ("Terms") govern your use of the Boatr app ("the app").
By using the app, you agree to comply with and be bound by these Terms. If you do not agree, you must stop using the app.
1. About Boatr
Boatr ("Boatr", "we", "our", or "us") is an independent Australian boating app that helps you keep track of your boat and find marine businesses and places on the water.
The app provides:
- A record of your boat and its details
- A trip logbook
- A maintenance and service schedule
- An equipment register
- A place to keep documents and their expiry dates
- A defect log
- Reminders for documents and services that are coming due
- A weather forecast for your location, or any Australian place you search for
- A map of marinas, anchorages, boat-access restaurants and other places on the water
- A directory of marine businesses
The app is free to download and free to use. It has no accounts, no memberships, no subscriptions, no in-app purchases and no payments of any kind. There is nothing to sign up for and nothing to cancel — the app is used exactly as installed.
“Refer a Friend” on the Settings screen simply offers a link to boatr.au through your device’s own share sheet, or copies that link if sharing is unavailable. It is the same link for everyone, it does not identify you or the person you send it to, and there is no reward, credit or referral scheme attached to it.
2. Acceptance of Terms
By using the app, you confirm that:
- You have read and understood these Terms
- You agree to comply with these Terms
- You are at least 16 years old
- If you are under 18, a parent or guardian agrees to these Terms on your behalf
- You will use the app lawfully and responsibly
4. Your Information and Your Device
Everything you enter into the app is stored on your device. Boatr has no server, holds no copy of your information, and cannot retrieve it.
You are responsible for:
- The accuracy of the information you enter
- Keeping your own records of anything you cannot afford to lose
- Your device and the information stored on it
Because nothing is backed up by Boatr, information is permanently lost if you delete it, clear the app’s data, or remove the app. It cannot be recovered by you or by us.
5. App Content and Information
Boatr aims to provide useful, independent boating information. However:
- Content is provided for general informational purposes only
- We do not guarantee accuracy, completeness, or suitability
- Information may become outdated or contain errors
- Content should not replace professional marine, financial, legal, insurance, or technical advice
- You should independently verify important information before making decisions
Weather forecasts are supplied by a third party and are provided as a convenience. They are computer model output, not an official forecast. They are not a substitute for official marine forecasts, warnings or navigational information. Do not rely on the app for decisions affecting safety of life at sea. The app does not show tide, swell or wind information.
Business directory entries are compiled from publicly available sources and may be incomplete or out of date. Contact details are published by the businesses themselves and may change without notice.
No business has paid to appear in the directory, and no business has been asked to appear in it. A listing is not an endorsement, a recommendation, a qualification check or evidence of any commercial relationship between that business and Boatr. Each entry’s short description is generated from the category and the state that entry is filed under, and says nothing else about the business.
If you are listed and something is wrong, the Industry Directory screen carries a “Report or remove a listing” link that emails us at hello@boatr.au. We will correct or remove a listing on request from the business it names.
The map of places on the water — marinas, anchorages and public moorings, boat-access restaurants, fuel wharfs, boat ramps and similar spots — is compiled by Boatr from publicly available sources, including the open government datasets credited on the map. Its short labels describe a place in general terms and are not an assessment of shelter, depth, holding, access or safety in any given conditions. Locations are a guide only — not charted, and not for navigation. Always use official charts.
If a place on the map is wrong, has closed, or should not be listed, the BoatMap screen carries a warning-triangle button that opens “Feedback & Support”, where you can email us at hello@boatr.au. We will correct or remove it.
Map locations for directory businesses are derived from OpenStreetMap (© OpenStreetMap contributors), from the Geocoded National Address File (G-NAF © Geoscape Australia, licensed by the Commonwealth of Australia under the Open G-NAF End User Licence Agreement) and from addresses those businesses publish. A business is shown on the map only where a location could be established, so most of the directory has no pin. A pin marks a business’s stated address, not a verified place of trade, and should not be used for navigation.
Any decisions made using the app are made at your own risk.
6. What You Send Us
The app lets you write to us: to ask for help, to report a business listing, and to report or suggest a place for the map. Each of these opens a message in your own email app that you send yourself. Sending one is your choice, and nothing is sent until you send it.
If you send us something, you confirm that:
- What you tell us is true as far as you know
- You are entitled to send it — it is not confidential to someone else, and any photograph or link you send is yours to share
- You are not sending personal information about another person without their agreement
If you suggest a place for the map, or tell us a listing is wrong, you give us permission to use what you sent to check, correct, add or remove that entry, and to publish the resulting entry in the app. We are not obliged to use it, and we may check it, change it, or decide not to publish it. Your name and email address are not published.
You are not paid for anything you send us and nothing you send creates a partnership, employment or agency relationship with Boatr. How we handle a message you send is set out in our Privacy Policy.
7. No Brokerage or Sales Representation
Unless explicitly stated otherwise:
- Boatr is not a licensed boat broker
- Boatr does not act as a buyer’s agent
- Boatr does not guarantee transactions between users and third parties
- Boatr does not inspect or certify vessels
- Boatr does not endorse specific sellers, brokers, or manufacturers
References to products, vessels, businesses, or services do not constitute endorsements.
8. Acceptable Use
You agree not to:
- Use the app unlawfully
- Misuse, disrupt, or interfere with the app
- Attempt unauthorised access to systems or data
- Extract or republish the app’s data without permission
- Infringe intellectual property rights
- Use the app for fraudulent or misleading purposes
9. Intellectual Property
All content and materials in the app, including:
- Branding
- Logos
- Graphics
- App design
- Databases
- Software
- Text
- Images
- Visual assets
are owned by or licensed to Boatr and protected by intellectual property laws.
You may not:
- Copy
- Republish
- Modify
- Distribute
- Commercialise
- Reverse engineer
- Reproduce
any part of the app without prior written consent. Limited personal, non-commercial use is permitted.
10. Third-Party Services and Links
The app contains links and references to third-party websites, businesses and services, and requests weather, mapping and imagery data from third-party providers. When a map is drawn, the mapping provider also counts that map load for its own purposes; what that report contains, and what it does not, is set out in our Privacy Policy.
Boatr:
- Does not control third-party services
- Is not responsible for third-party content
- Does not guarantee third-party accuracy or availability
- Is not responsible for transactions with third parties
Your interactions with third-party providers are solely between you and the provider.
11. Availability of the App
We may:
- Modify features
- Remove content
- Update the app
- Discontinue features without notice
We do not guarantee uninterrupted or error-free operation. Features that rely on third-party services, including weather forecasts and maps, require an internet connection and may be unavailable.
12. Limitation of Liability
To the maximum extent permitted by law, Boatr excludes liability for:
- Indirect or consequential loss
- Loss of profits or revenue
- Loss of business opportunities
- Loss of data
- Vessel purchase decisions
- Financial or investment decisions
- Third-party conduct
- Service interruptions
- Errors or inaccuracies
Your use of the app is at your own risk.
Where liability cannot legally be excluded, our liability is limited to the maximum extent permitted under Australian Consumer Law.
13. Indemnity
You agree to indemnify and hold Boatr harmless from claims, damages, liabilities, costs, or expenses arising from:
- Your misuse of the app
- Breach of these Terms
- Violation of applicable laws
- Infringement of third-party rights
14. Privacy
Your use of the app is subject to our Privacy Policy.
15. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
You agree to submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
16. Changes to These Terms
We may update or amend these Terms from time to time.
Updated Terms become effective once published. Continued use of the app after changes are published constitutes acceptance of the revised Terms.
